13. CALIFORNIA USERS

California residents waive California Civil Code Section 1542, which states that a general release does not extend to claims which the creditor does not know or suspect to exist at the time of executing the release.

14. GOVERNING LAW

These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts located in Otsego County, New York.

15. DISPUTE RESOLUTION & BINDING ARBITRATION

A. Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms of Use, the Site, or any Services provided by SATTVIKA LLC, including but not limited to educational programs or consultations, shall be resolved exclusively through final and binding arbitration, rather than in court.

This agreement to arbitrate is governed by the Federal Arbitration Act.

B. Scope of Arbitration

This arbitration agreement applies to all claims, including but not limited to:

• Contract claims

• Tort claims

• Negligence claims

• Misrepresentation claims

• Statutory claims

• Health-related claims

• Consumer protection claims

It applies regardless of the legal theory.

C. Arbitration Procedure

Arbitration shall be administered by a mutually agreed-upon arbitration provider. If the parties cannot agree, arbitration shall be conducted by a neutral arbitrator selected in accordance with standard arbitration rules.

The arbitration shall take place in the State of New York, unless otherwise agreed.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

D. Waiver of Jury Trial

You and SATTVIKA LLC knowingly and voluntarily waive any right to a trial by jury in any dispute arising under these Terms or the Services.

E. Class Action Waiver

All claims must be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

The arbitrator may not consolidate claims or preside over any class action.

F. Small Claims Exception

Either party may bring an individual claim in small claims court in New York, provided the claim qualifies and remains in that court.

G. Severability

If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect.

16. MODIFICATIONS

We reserve the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.
